One can use the techniques of critical thinking in solving the problems of daily life. As a citizen I can apply the techniques off critical thinking in my daily life. For example, in my daily life, how should I manage my priorities and my time, all these aspects are important factors of life that can be well managed by the principles of critical thinking. For example, my personal experience tells me that the moon is largest after it has risen over the eastern horizon or the time when it just sets on the western horizon. It is smallest when it is in the night sky above my head. It is clear to me that it is true; I have seen it several times with my own eyes. But what my personal experience tells me regarding this fact is false in a way. The apparent increase in the size of the moon when it is near the horizon is actually an optical illusion. In fact, the moon is neither closer to Earth nor does its actu al size increase when it is closer to the horizon than when it is directly above my head. For many of us, our personal experiences seem to be the most coercing kind of evidence on which to base our beliefs. But, as the example of the illusion of the moon shows us, compelling personal experiences may result us in believing which is not true. Here, critical thinking helps in searching for the right and correct conclusion which satisfies our mind. In case of teaching and learning, there can be several different strategies used in critical thinking like think/pair/share, jigsaw, one stay other stray, reciprocal teaching, mini-lecture, active lessoning and so on. Teens are evil, corrupt beings and a curfew is all the world needs to cage up teen crime. Though most of Earls wise teachings are true and insightful, on this subject he is terribly mistaken. Teen curfews are not the right solution to the problem of juvenile crime because they enroach on the rights of teens and parents, are ineffective, and there are much better solutions. First of all, how can teen curfews be a good solution if they enroach on the rights of teens and their parents? Civil rights groups, such as the American Civil Liberties Union (ACLU) stand up for the rights of Americans as given to them by the Constitution of the United States. Teen curfews violate First Amendment rights, particularly the right to assemble. According the time line taken from Milestones in Teen Curfews in the United States, the courts agreed in 1989. U.S. District Judge Charles Richey blocked the implementation of a Washington DC curfew, essentially calling it unconstitutional. He said the ordinance would raise serious constitutional claims for teens. Curfews constitutionality was again questioned in November 1995 when the ACLU filed a lawsuit in U.S. District court. Then again in July 2000 the rights of American teens prevailed when a federal district court judge found that Indianas 1945 curfew violates the Fourth Amendment of the U.S. Constitution. Advocates of juvenile rights and upholding the Constitution also make it clear that curfews invade on the rights of parents to raise their children. Laws exist to protect citizens, not suppress their basic freedoms as guaranteed by the Bill of Rights in the Constitution. A primary reason curfews are not the right solution to the problem of juvenile crime is that they are not, have not been, and will not be effective. If teen curfews really are effective, then it would be assumed that there would be a decrease in the juvenile crime rate, or at least a maintenance of status quo. Statistics show that most juvenile crime occurs between the hours of 3 P.M. and 6 P.M.  Thus it would be fruitless to enact curfews that do not attack the problem head on. As James Alan Fox, the dean of the College of Criminal Justice at Northeastern University, says, The problem with curfew laws is that most kids, the good, the bad and the tired, are asleep at midnight. Past curfews faced these same problems. The time line shows that many cities had passed curfew laws by the 1980s, yet the juvenile violent-crime rate surges upward. There have been numerous attempts to combat juvenile crime through positive means and many have been successful. In 1936, the Police Athletic League (PAL) was founded in New York City. PAL worked effectively to give teens a positive alternative to juvenile crime. In 1953 Boys and Girls Clubs of America are established. These offer social, educational, career and leadership programs to disadvantaged youths. In 1974 the Juvenile Justice and Delinquency Prevention Act established the Office of Juvenile Justice and Delinquency Prevention (OJJDP) which gave funds to states to take on juvenile crime. With more  funding and proper management of funds, more programs could be created and those that exist could be expanded and improved. However, the rectification of the problem must not include teen curfews. Curfews infringe on the rights guaranteed by the Constitution and are ineffective. Altamirano, Clemencia, se encuentra este tipo de predominio y es posible demostrar que en esta novela la emocion es mas importante que la razon. Primero, por medio de los sentimientos expresados por el narrador al relatar la historia. Segundo, a traves de los personajes pricipales y sus sentimientos, especialmente los de Clemencia, quien parece ser la persona por la cual fue titulada esta novela. The legal issues in this case are whether Alice has the legal capacity to the contract and whether Alice has the right to repudiate the contract. If the second question is answered affirmative, what the effect of repudiation will occur in this case? Should Alice return the silverware and should she be liable to the lost of teaspoons? Finally, should the Silver Flatware Ltd. Refund the money had been paid by Alice? The plaintiff’s argument would be that the defendant must return the goods if she wants to repudiate the contract. The lost of teaspoons should be counted as damage to the goods and the plaintiff is entitled to recover the loss by charging compensation from the defendant. The defendant’s argument would be that she has the right to repudiate the contract since she was a minor while entering into the contract and she repudiated the contract before her attaining of the age of majority. The defendant has the option to repudiate the contract because the contract has not been fully performed and it was signed for purchasing non-necessary goods. The defendant was entitled to a return of the payment as she was a minor at the time she entered into the contract. The defendant was not liable to the lost of teaspoons since it was not a direct result of the minor’s deliberate act and it was not recoverable by the merchant. In my opinion, the probable decision of the court would be that the defendant must return the goods and the plaintiff must refund all the monies paid by the defendant. The defendant must return the goods before the plaintiff is obliged to return the monies paid. The defendant is not liable to the lost parts of the goods. The reasons for the probable decisions are as follows. Firstly, public policy dictates that minors should not be bound by their promises. The defendant did not have the legal capacity to a contract since she entered into the contract and repudiated the contract before her attaining of the age of majority. Secondly, the contract has not been fully performed as the defendant has not made full payment of the goods, so the contract is voidable at the defendant’s option. Thirdly, the goods purchased was a non-necessary goods since the silverwork is commonly considered as luxury but not necessary. Therefore, the plaintiff is not liable on such contract. According to the reasons stated above, the defendant who is a minor has the right to repudiate the contract at any time and at her option, for the reason of the contract has not been fully performed and it was for purchasing non-necessary goods. Additionally, once the contract has been repudiated, the minor is entitled to a return of any deposit paid to the adult contractor. Since the minor has purchased the goods on credit and taken delivery, the minor must return the goods before the merchant is obliged to return any monies paid. Finally, the loss of loosing teaspoons is not recoverable by the merchant because there is no evidence provided to proof that the loss is a direct result of the minor’s deliberate act.
